1. Introduction and Acceptance

Welcome to Appsicle ("the App," "we," "us," or "our"), a Shopify application designed to help Shopify store owners display their Instagram feed on their e-commerce store.

These Terms of Service ("Terms") govern your access to and use of the Appsicle application. By installing, accessing, or using the App, you signify that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Instagram Integration

2.1 Authorization

To use the core functionality of the App, you must authorize the App to connect to your Instagram account. This authorization is facilitated through Meta's platform.

2.2 Scope of Access

The App requests access to your public Instagram profile information and media. We only access data required to display your Instagram feed on your Shopify store.

2.3 Compliance

Your use of the App is subject to Instagram's Terms of Use and Platform Policies. You are responsible for ensuring your Instagram content complies with Instagram's policies.

2.4 No Endorsement

The App is an independent application not endorsed by, affiliated with, or sponsored by Instagram or Meta Platforms, Inc.

3. App Usage and Responsibilities

3.1 Eligibility

To use the App, you must be a registered Shopify merchant with the legal capacity to enter into this agreement.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately of any unauthorized use.

3.3 Prohibited Uses

  • Violating any applicable laws or regulations
  • Infringing on intellectual property rights
  • Attempting unauthorized access to the App
  • Disrupting or interfering with App functionality
  • Transmitting harmful materials or code
  • Collecting information without authorization
  • Misrepresenting your identity
  • Displaying offensive or harmful content
  • Reverse engineering or decompiling the App

4. Intellectual Property

4.1 Our Property

All content, features, and functionality of the App are owned by Appsicle or its licensors and are protected by intellectual property laws.

4.2 Your Content

You retain all rights to your Instagram content displayed through the App. You grant us a limited license to access and display your content solely for providing our services.

5. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6. Limitation of Liability

IN NO EVENT SHALL APPSICLE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, RESULTING FROM YOUR USE OF THE APP.

7. Indemnification

You agree to defend, indemnify, and hold harmless Appsicle from any claims, damages, or expenses arising from your use of the App, breach of these Terms, or your content displayed through the App.

8. Modifications

We reserve the right to modify these Terms at any time. Material changes will be notified at least 30 days in advance. Continued use after changes become effective constitutes acceptance of the revised terms.

9. Termination

We may terminate or suspend your access to the App immediately for any breach of these Terms. Upon termination, your right to use the App ceases immediately. You may terminate by uninstalling the App from your Shopify store.

10. Miscellaneous

10.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us.

10.2 Severability

If any provision is held invalid, the remaining provisions remain in full effect.

10.3 Waiver

No waiver of any term shall be deemed a continuing waiver of such term or any other term.
